1. Acceptance
These Terms & Conditions apply to the website and custom WhatsApp AI chatbot, n8n automation, workflow setup, and related services provided by Mentigo. By using the website or engaging our services, you agree to these Terms.
2. Nature of Service
Mentigo is a custom service provider. The website does not currently provide self-serve bot creation, instant account signup, or an automated chatbot builder. Services are manually planned and configured for each client.
Deliverables may include WhatsApp conversation design, AI prompts, n8n workflows, webhook setup, integrations, testing, documentation, and launch support, depending on the agreed project scope.
3. WhatsApp Business Platform Compliance
WhatsApp is a trademark and service of Meta Platforms, Inc. Mentigo is not affiliated with, endorsed by, or sponsored by Meta or WhatsApp.
- Clients must comply with Meta's WhatsApp Business Platform terms, policies, commerce rules, and messaging requirements.
- Clients must obtain and maintain customer opt-in before sending WhatsApp messages.
- Clients must provide a clear way for customers to opt out of further messages where applicable.
- Message templates, display names, business verification, quality ratings, rate limits, and account restrictions are controlled by Meta or the relevant WhatsApp Business API provider.
- We may refuse or stop work that appears to violate WhatsApp policy, Indian law, or accepted anti-spam practices.
4. Client Responsibilities
- Provide accurate business information, FAQs, pricing, policies, and approved content for the chatbot.
- Review and approve workflows, prompts, messages, templates, and integrations before launch.
- Maintain lawful customer consent and privacy notices for WhatsApp communication.
- Protect access to WhatsApp Business Manager, API providers, n8n instances, CRMs, spreadsheets, and other connected tools.
- Monitor live conversations and handle escalations, complaints, refunds, medical/legal/financial questions, or other sensitive matters through qualified humans.
5. Prohibited Use
You must not use our services for:
- Spam, unsolicited bulk messaging, purchased lists, or deceptive lead generation.
- Fraud, phishing, impersonation, scams, harassment, hate, threats, or illegal activity.
- Misleading claims, unsafe advice, or regulated services without the required licences and disclaimers.
- Collection of unnecessary sensitive personal data.
- Any activity that violates Meta policies, Indian law, or third-party rights.
6. AI Limitations
AI-generated responses may be inaccurate, incomplete, delayed, or unsuitable for certain situations. Clients are responsible for approving bot content, setting guardrails, monitoring performance, and deciding when human review is required. The service should not be used as the sole source of professional medical, legal, financial, emergency, or safety-critical advice.
7. Integrations and Third-Party Services
Workflows may rely on Meta, WhatsApp Business API providers, AI model providers, hosting services, n8n, CRMs, spreadsheets, calendars, email services, analytics tools, or other third-party systems. Their availability, pricing, limits, policies, and data handling are outside our full control. Service interruptions or policy changes by third parties may affect the automation.
8. Fees, Scope, and Changes
Project fees, timelines, maintenance, and included deliverables are agreed separately with each client. Additional workflows, integrations, revisions, message template work, API provider costs, hosting, AI usage, Meta charges, or third-party subscriptions may require additional fees. Work outside the agreed scope may be quoted separately.
9. Data and Confidentiality
Each party should protect confidential business information, credentials, workflow details, and customer data. Clients must avoid sharing unnecessary sensitive data and must provide only the access required for the project. Our handling of personal data is described in the Privacy Policy.
10. Suspension or Refusal of Service
We may refuse, pause, or terminate service if a client uses the automation for spam, illegal activity, policy violations, non-payment, security risk, abusive behaviour, or any use that could harm customers, platforms, or our service.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Mentigo will not be liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages. Our total liability for a project will not exceed the amount paid to us for that specific project or service period, unless a different limit is required by law.
12. Indemnity
Clients agree to defend and indemnify Mentigo against claims, losses, penalties, damages, or expenses arising from their customer messaging, business content, consent failures, unlawful use, third-party rights violations, or breach of these Terms.
13. Governing Law
These Terms are governed by the laws of India. Subject to any mandatory legal requirements, disputes will be handled by the competent courts in India as agreed in the applicable project arrangement or as otherwise required by law.
14. Changes to Terms
We may update these Terms from time to time. The latest version will be posted on this page with a revised date.
